Dear Villas Mallorca HOA Board,
It has come to my attention that
tree trimming has
been scheduled for next week at Villas
Mallorca. Attached please find a petition
signed by the majority of our owners in
residence who are opposed to mass
removals of giant
bird-of-paradise trees. This includes trees
in front of my unit as well as trees on
other parts of the property. As granted in
the Villas Mallorca CC&Rs Article 4.3, we
now call for a special session to discuss
this matter. Here are issues that must be
considered.
1. In the case of the trees in front of 8666
(my unit), the October 2008 board meeting
minutes authorize removal of at most four
trees per tree
trimming. This total includes trees from
all three clumps outside my home. Multiple
clumps are included in this total. This can
be deduced from the fact that 16 trees are
subject to removal in the minutes, and there
is no single clump (or pair of clumps)
containing that many trees outside my unit.
The details of the plant layout are
described in a clarifying document I
submitted to the HOA board in August 2008.
Finally, recall that two trees from these
clumps were already removed by Western
Tree Service in
November 2008. Again, the board has
approved *four* bird-of-paradise
removals per
trimming.
2. Have you you given sufficient notice to
homeowners that tree
removals will take
place at a particular date? Have you made
your tree removal
decisions in a public forum? Have you made
public which trees are targeted for
removal? Have the plants been itemized in a
public document or display?
3. Do you have a document of expert opinion
that supports your tree
removal decisions? Do you have a plan for
removing the remaining, unsightly stumps and
replacing them with appropriate landscape
covering?
I look forward to resolving these issues
with you at the special session. Damages to
our property caused by improper procedure
will not be taken lightly.
